A BILL 
To amend subchapter II of chapter 301 of title 49, United 

States Code, to require crash avoidance technologies, and 
for other purposes. 

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘21st Century Smart 4

Cars Act’’. 5

SEC. 2. CRASH AVOIDANCE RULEMAKING. 6

(a) IN GENERAL.—Subchapter II of chapter 301 of 7

title 49, United States Code, is amended by adding at the 8

end the following: 9

‘‘§ 30129. Crash avoidance rulemaking 1

‘‘(a) IN GENERAL.—Not later than 2 years after the 2

date of enactment of this Act, the Secretary shall issue 3

final rules prescribing Federal motor vehicle safety stand-4

ards that— 5

‘‘(1) establish minimum performance require-6

ments for the crash avoidance technologies described 7

in subsection (b); and 8

‘‘(2) require all new passenger motor vehicles 9

manufactured for sale in the United States, intro-10

duced or delivered for introduction in interstate com-11

merce, or imported into the United States to be 12

equipped with the crash avoidance technologies de-13

scribed in subsection (b). 14

‘‘(b) CRASH AVOIDANCE TECHNOLOGIES.—The Sec-15

retary shall issue Federal motor vehicle safety standards 16

for each of the following crash avoidance technologies— 17

‘‘(1) forward collision warning and automatic 18

emergency braking, including crash imminent brak-19

ing and dynamic brake support, that detects poten-20

tial collisions with a vehicle, object, pedestrian, bicy-21

clist, and other vulnerable road user while the vehi-22

cle is traveling forward, provides a warning to the 23

driver, and automatically applies the brakes to avoid 24

or mitigate the severity of an impact; 25

‘‘(2) rear automatic emergency braking that de-1

tects a potential collision with a vehicle, object, pe-2

destrian, bicyclist, and other vulnerable road user 3

while a vehicle is moving in reverse and automati-4

cally applies the brakes to avoid or mitigate the se-5

verity of an impact; 6

‘‘(3) rear cross traffic warning that detects ve-7

hicles, objects, pedestrians, bicyclists, and other vul-8

nerable road users approaching from the side and 9

rear of a vehicle as it moves in reverse and alerts 10

the driver; 11

‘‘(4) lane departure warning that monitors a ve-12

hicle’s position in its lane and alerts the driver as 13

the vehicle approaches or crosses lane markers; and 14

‘‘(5) blind spot warning that detects a vehicle, 15

object, pedestrian, bicyclist, and other vulnerable 16

road user to the side or rear of a vehicle and alerts 17

the driver to their presence, including when a driver 18

attempts to change the course of travel toward an-19

other vehicle or road user in the blind zone of the 20

vehicle. 21

‘‘(c) CONSIDERATIONS.—In prescribing the Federal 22

motor vehicle safety standards required in subsection (a), 23

the Secretary shall ensure that the crash avoidance tech-24

nologies perform effectively at speeds for which a pas-25

senger motor vehicle is reasonably expected to operate, in-1

cluding on city streets and highways. 2

‘‘(d) COMPLIANCE DATE.—The compliance date of 3

the standards prescribed under subsection (a) shall not ex-4

ceed more than two model years from the date final rules 5

are issued. 6

‘‘(e) HEADLAMPS.— 7

‘‘(1) Not later than two years after the date of 8

enactment of this Act, the Secretary shall issue a 9

final rule that revises Federal motor vehicle safety 10

standard 108 to— 11

‘‘(A) improve illumination of the roadway; 12

‘‘(B) prevent glare; and 13

‘‘(C) establish minimum performance 14

standards for— 15

‘‘(i) semi-automatic headlamp beam 16

switching; and 17

‘‘(ii) curve adaptive headlamps. 18

‘‘(2) The compliance date of the revised stand-19

ard prescribed under paragraph (1) shall not exceed 20

more than two model years from the effective date. 21

‘‘(3) Not later than 1 year after the date of en-22

actment of this Act, the Secretary shall finalize the 23

Rulemaking (83 Fed. Reg. 51766) to permit the cer-24

tems. 2

‘‘(f) DEFINITIONS.—In this section: 3

‘‘(1) CRASH AVOIDANCE.—The term ‘crash 4

avoidance’ has the meaning given that term in sec-5

tion 32301. 6

‘‘(2) PASSENGER MOTOR VEHICLE.—The term 7

‘passenger motor vehicle’ has the meaning given to 8

that term in section 32101.’’. 9

(b) CONFORMING AMENDMENT.—The analysis for 10

subchapter II of chapter 301 of title 49, United States 11

Code, is amended by adding after the item relating to sec-12

tion 30128 the following: 13

‘‘30129. Crash avoidance rulemaking.’’. 

SEC. 3. RESEARCH OF ADVANCED CRASH SYSTEMS. 14

(a) IN GENERAL.—Subchapter II of chapter 301 of 15

title 49, United States Code, as amended by section 2, 16

is further amended by adding at the end the following: 17

‘‘§ 30130. Advanced crash systems research and con-18

sumer education 19

‘‘(a) ADVANCED CRASH SYSTEMS RESEARCH.— 20

‘‘(1) Not later than 2 years after the date of 21

enactment of this Act, the Secretary shall complete 22

research into the following: 23

‘‘(A) Driver monitoring systems that will 24

minimize driver disengagement, prevent auto-25

mation complacency, and account for foresee-1

able misuse of the automation. 2

‘‘(B) Lane keeping assistance that assists 3

with steering to keep a vehicle within its driving 4

lane. 5

‘‘(C) Intersection movement assistance. 6

‘‘(D) Automatic crash data notification 7

systems that— 8

‘‘(i) notify emergency responders that 9

a crash has occurred and provide the geo-10

graphical location of the vehicle and crash 11

data in a manner that allows for assess-12

ment of potential injuries and emergency 13

response; and 14

‘‘(ii) transfer to the Secretary 15

anonymized automatic crash data for the 16

purposes of safety research and statistical 17

analysis. 18

‘‘(2) REQUIREMENTS.—In conducting the re-19

search required under subsection (a), the Secretary 20

shall— 21

‘‘(A) develop one or more tests to evaluate 22

the performance of the system; 23

‘‘(B) determine metrics that would be most 1

effective at evaluating the performance of the 2

system; and 3

‘‘(C) determine fail, pass or advanced pass 4

criteria to assure the systems are performing 5

their intended function. 6

‘‘(3) REPORT.—The Secretary shall submit a 7

report detailing findings from the research required 8

under subsection (a) to the House Energy and Com-9

merce Committee and the Senate Commerce, 10

Science, and Transportation Committee not later 11

than three years after the date of enactment of this 12

Act. 13

‘‘(4) RULEMAKING.—Not later than four years 14

after the date of enactment of this Act, the Sec-15

retary shall issue final rules to establish Federal 16

motor vehicle safety standards for the advanced 17

crash systems described in this subsection and to re-18

quire all new passenger motor vehicles manufactured 19

for sale in the United States produced after the ef-20

fective date of such standards to be equipped with 21

advanced crash systems described in this subsection. 22

‘‘(b) RULEMAKING ON POINT OF SALE INFORMA-23

TION.—Not later than 18 months after the date of enact-24

ment of this Act, the Secretary shall issue a final rule to 25

require clear and concise information about the capabili-1

ties and limitations of an advanced driver assistance sys-2

tem to be provided to a consumer at the point of sale and 3

in the vehicle owner’s manual, including a publicly acces-4

sible electronic owner’s manual.’’. 5

(b) CONFORMING AMENDMENT.—The analysis for 6

subchapter II of chapter 301 of title 49, United States 7

Code, is amended by adding after the item relating to sec-8

tion 30129, as added by section 2(b), the following: 9

‘‘30130. Advanced crash systems research and consumer education.’’.
