A BILL 
To amend the Uniformed and Overseas Citizens Absentee 

Voting Act to ensure that absent uniformed services vot-
ers serving at diplomatic and consular posts of the 
United States are able to receive and transmit balloting 
materials in the same manner and with the same rights 
and protections as other absent uniformed services voters 
under such Act, and for other purposes.

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Counting All Military 4

Votes Act’’. 5

SEC. 2. ABILITY OF ABSENT UNIFORMED SERVICES VOTERS 6

SERVING AT DIPLOMATIC AND CONSULAR 7

POSTS TO RECEIVE AND TRANSMIT BAL-8

LOTING MATERIALS. 9

(a) ENSURING ABILITY.— 10

(1) IN GENERAL.—Section 101(b) of the Uni-11

formed and Overseas Citizens Absentee Voting Act 12

(52 U.S.C. 20301(b)) is amended— 13

(A) by striking ‘‘and’’ at the end of para-14

graph (10); 15

(B) by striking the period at the end of 16

paragraph (11) and inserting ‘‘; and’’; and 17

(C) by adding at the end the following new 18

paragraph: 19

‘‘(12) take such actions as may be necessary to 20

ensure that an absent uniformed services voter who 21

is absent from the United States by reason of active 22

duty or service at a diplomatic and consular post of 23

the United States is able to receive and transmit 24

balloting materials in the same manner and with the 25

by reason of active duty or service at a military in-3

stallation.’’. 4

(2) EFFECTIVE DATE.—The amendment made 5

by paragraph (1) shall apply with respect to elec-6

tions held on or after the date of the enactment of 7

this Act. 8

(b) CLARIFICATION OF TREATMENT AS ABSENT UNI-9

FORMED SERVICES VOTERS.—Section 107(1)(A) of such 10

Act (52 U.S.C. 20310(1)(A)) is amended by striking ‘‘ac-11

tive duty’’ and inserting ‘‘active duty (including active 12

duty or service at a diplomatic and consular post of the 13

United States)’’. 14
