This Act may be cited as the ‘‘Fair Indexing for 4

Health Care Affordability Act’’. 5

SEC. 2. PREMIUM ADJUSTMENT PERCENTAGE. 1

Section 1302(c)(4) of the Patient Protection and Af-2

fordable Care Act (42 U.S.C. 18022(c)(4)) is amended by 3

striking ‘‘calendar year)’’ and inserting ‘‘calendar year, 4

based on estimates and projections for the applicable cal-5

endar year of the percentage (if any) by which the average 6

per enrollee premium for employer-sponsored insurance 7

exceeds such average per enrollee premium for the pre-8

ceding calendar year, as published in the National Health 9

Expenditure Accounts)’’. 10
