A BILL 
To amend title 31, United States Code, to prohibit adminis-

trative offsets of social security benefit payments and 
social security disability insurance benefit payments with 
respect to claims arising from Federal student loans, 
and for other purposes.

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘No Garnishing of So-4

cial Security for Student Debt Act’’. 5

SEC. 2. PROHIBITION OF CERTAIN ADMINISTRATIVE OFF-1

SETS. 2

(a) IN GENERAL.—Section 3716(c)(3)(A) of title 31, 3

United States Code, is amended— 4

(1) in clause (i), by striking ‘‘as provided in 5

clause (ii)’’ and inserting ‘‘as provided in clauses (ii) 6

and (iii)’’; and 7

(2) by adding at the end the following new 8

clause: 9

‘‘(iii) No claim arising from a loan made, insured, 10

or guaranteed under title IV of the Higher Education Act 11

of 1965 (20 U.S.C. 1070 et seq.) may be collected by ad-12

ministrative offset of any payment described in clause 13

(i).’’. 14

(b) APPLICABILITY.—The amendments made by this 15

Act shall apply only with respect to payments that become 16

due to an individual after the date of enactment of this 17

Act. 18
