lowing bill; which was referred to the Committee on Transportation and

A BILL 
To amend title 23, United States Code, with respect to 

vehicle weight limitations for certain vehicles hauling per-
ishable commodities or products, and for other purposes. 

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Freight Restriction 4

Elimination for Safer Hauling Act of 2019’’. 5

SEC. 2. VEHICLE WEIGHT LIMITATIONS-INTERSTATE SYS-6

TEM. 7

Section 127 of title 23, United States Code, is 8

amended by adding at the end the following: 9

‘‘(v) VEHICLES HAULING PERISHABLE COMMOD-1

ITIES OR PRODUCTS.— 2

‘‘(1) IN GENERAL.—A State may waive the ap-3

plication of any vehicle weight limit established 4

under this section with respect to a covered vehicle 5

hauling a perishable commodity or product. 6

‘‘(2) DEFINITIONS.—In this subsection: 7

‘‘(A) COVERED VEHICLE HAULING A PER-8

ISHABLE COMMODITY OR PRODUCT.—The term 9

‘covered vehicle hauling a perishable commodity 10

or product’ means a vehicle that— 11

‘‘(i) is carrying— 12

‘‘(I) a perishable agricultural 13

commodity (as defined in section 14

1(b)(4) of the Perishable Agricultural 15

Commodities Act, 1930 (7 U.S.C. 16

499a(b)(4)); 17

‘‘(II) concrete in an unhardened 18

state; 19

‘‘(III) live poultry; 20

‘‘(IV) raw or unfinished forest 21

products, including logs, pulpwood, 22

biomass, or wood chips; 23

‘‘(V) livestock feed; or 24

‘‘(VI) other products or commod-1

ities that could be deemed not useful 2

after a specified amount of time in ac-3

cordance with industry standards and 4

practices, as defined by a State; 5

‘‘(ii) meets the weight tolerances (or 6

weight limits) and vehicle configurations of 7

the State in which the vehicle is operating 8

and, if applicable, point of origin radius 9

distances within the State boundaries in 10

which the vehicle is operating; and 11

‘‘(iii) is equipped with speed-limiting 12

technology that is turned on and set at a 13

speed not greater than the lesser of— 14

‘‘(I) the posted speed limit; or 15

‘‘(II) 65 miles per hour. 16

‘‘(B) SPEED-LIMITING TECHNOLOGY.—The 17

term ‘speed-limiting technology’ means a tech-18

nology that prevents a commercial motor vehicle 19

from exceeding a preprogramed maximum 20

speed.’’. 21
