A BILL 
To amend the Fair Housing Act to require a complaint 

of sexual harassment be annually reported to Congress, 
and for other purposes. 

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Preventing Sexual 4

Harassment in Public Housing Act of 2020’’. 5

SEC. 2. REQUIREMENT TO ANNUALLY REPORT COM-6

PLAINTS OF SEXUAL HARASSMENT. 7

(a) ANNUAL REPORT.—Section 808(e)(2) of the Fair 8

Housing Act (42 U.S.C. 3608(e)(2)) is amended— 9

(1) in subparagraph (A) by striking ‘‘and’’ at 1

the end; 2

(2) in subparagraph (B)(iii) by striking the 3

semicolon and inserting ‘‘; and’’; and 4

(3) by inserting after subparagraph (B) the fol-5

lowing new subparagraph: 6

‘‘(C) containing tabulations of the number 7

of instances in the preceding year in which 8

complaints of discriminatory housing practices 9

were filed with the Department of Housing and 10

Urban Development or a fair housing assistance 11

program, including identification of whether 12

each complaint was filed with respect to dis-13

crimination based on race, color, religion, na-14

tional origin, sex, handicap, or familial status.’’. 15

(b) SEXUAL HARASSMENT.—Section 808 of the Fair 16

Housing Act (42 U.S.C. 3608) is amended by adding at 17

the end the following new subsection: 18

‘‘(g) In carrying out the reporting obligations under 19

this section, the Secretary shall— 20

‘‘(1) consider a complaint filed with respect to 21

discrimination based on sex to include any complaint 22

filed with respect to sexual harassment; and 23

‘‘(2) in reporting the instances of a complaint 24

filed with respect to discrimination based on sex 25

under subsection (e)(2)(C), include a disaggregated 1

tabulation of the total number of such complaints 2

filed with respect to sexual harassment.’’. 3

(c) INITIATIVE TO COMBAT SEXUAL HARASSMENT IN 4

HOUSING.—Title 9 of the Fair Housing Act (42 U.S.C. 5

3631) is amended by adding at the end the following new 6

section: 7

‘‘SEC. 902. INITIATIVE TO COMBAT SEXUAL HARASSMENT IN 8

HOUSING. 9

‘‘The Attorney General shall establish an initiative to 10

investigate and prosecute an allegation of a violation 11

under this Act with respect to sexual harassment.’’. 12
