Physical injuries or death caused to a person; consideration of bills.

Requires that any bill that creates immunity from civil liability for physical injuries or death caused to a person include an appropriation of $50,000 to the Department of Medical Assistance Services for the provision of medical assistance services as a condition of consideration by the General Assembly. The bill requires that the $50,000 appropriation be included in a final enactment clause to such bill that creates immunity and requires the Department of Planning and Budget, in conjunction with other state agencies, to ensure that the fiscal impact statement for such bill states that the bill creates immunity from civil liability for physical injuries or death caused to a person.

    A BILL to amend the Code of Virginia by adding a section numbered 30-19.1:7.1, relating to General Assembly consideration of bills that create immunity from civil liability for physical injuries or death caused to a person; appropriation for the provision of medical assistance services required.

    Be it enacted by the General Assembly of Virginia:

    1. That the Code of Virginia is amended by adding a section numbered 30-19.1:7.1 as follows:

    30-19.1:7.1. Consideration of bills that create immunity from civil liability for physical injuries or death caused to a person.

    A. No bill that creates immunity, in whole or in part, from civil liability for physical injuries or death caused to a person shall be considered by the General Assembly unless such bill contains a final enactment clause appropriating $50,000 to the Department of Medical Assistance Services to be used for the provision of medical assistance services.

    B. For each bill that creates immunity from civil liability for physical injuries or death caused to a person, the Department of Planning and Budget, in conjunction with other state agencies, shall ensure that the fiscal impact statement prepared for the bill states that the bill creates immunity from civil liability for physical injuries or death caused to a person. The agency that prepared such fiscal impact statement shall forward copies of the same to the Clerk of the House of Delegates and the Clerk of the Senate for transmittal to the patron of the legislation and to the chairman of each committee and subcommittee of the General Assembly to which the bill is referred for consideration.
