Be it enacted by the General Assembly of Virginia:
 
 
1. That the Code of Virginia is amended by adding a section 
 numbered 15.2-2305.1 as follows:
 
 
� 15.2-2305.1. Affordable 
 housing near Metrorail station.
 
 
A. For purposes 
 of this section, "affordable dwelling 
 unit" means a dwelling unit affordable to individuals 
 whose household income is no greater 
 than 50 percent of the area 
 median household income.
 
 
B. Notwithstanding 
 any other provision of law, general or special, in any 
 locality with an existing or planned Metrorail 
 station, such 
 locality shall require that at least 10 percent 
 of new residential dwelling units in any 
 building that is at least six stories in 
 height be affordable dwelling units if the proposed project is within 
 one-half mile of an existing or planned Metrorail station.
 
 
C. This section 
 shall apply to an application for a rezoning or special exception approval 
 for a residential project or a mixed-use 
 project with a residential component.
 
 
D. Nothing in 
 this section shall be construed to repeal a localitys authority with regard 
 to affordable housing under any other provision of law.
